Frequently Asked Questions Regarding Pink-Slips and Layoffs
From the Galt Federation of Certificated and Classified Employees
This means that you MAY be laid off. The District is legally required to let you know of this possibility by March 15, 2009. According to California Education Code, the district is legally allowed to reduce its work-force. Please contact your union president immediately if you receive a pink slip!
No, the district will issue pink slips based on the need to balance its budget. Any teacher, probationary or permanent, may be impacted by the district’s actions. Pink slips are issued based on seniority.
3. What are my due process rights if I am a probationary or permanent teacher?
You have the right to be laid off in seniority order and you have the right to challenge your placement on the seniority list at a layoff hearing in front of an Administrative Law Judge.
The first contracted day you worked for this district. Summer school teaching and long-term subbing will probably not count.
5. What if I have questions about the seniority list or any other issue regarding the way the District is carrying out the lay-off process?
Contact your union president immediately if you have any questions.
6. Will GFCCE represent me in terms of the due process I am entitled to in this process?
Yes, GFCCE and our attorney will represent you if you wish. You will need to sign a "Power of Representation" form and complete a questionnaire about your employment history. There are very tight deadlines for returning these forms to the GFCCE.
7. What due process rights do I have if I am a temporary teacher? Why was I hired on a temporary contract?
If you are truly a temporary teacher then you do not have due process rights and you can be released from your temporary contract. The law allows districts in California to hire a certain number of teachers each year on temporary contracts. This is designed to give districts flexibility in times of budget reductions.
